Terms of Service

AgriVest is a livestock management platform built for cattle fattening programme operators in Kenya. It is operated by AgriVest (“we”, “us”, or “our”). By creating an account or using the platform, you (“you” or “your organisation”) agree to these Terms of Service. Please read them carefully.

These Terms apply to all users of the platform, including organisation administrators, staff members, and owner-investors accessing the owner portal.

AgriVest provides tools for managing cattle fattening programmes, including:

• Cattle registration and weight tracking
• Batch management and health record keeping
• Grazing fee calculation and settlement processing
• Owner-investor management and the owner self-service portal
• SMS and email notifications via third-party providers
• Financial reporting and data export

We reserve the right to modify, suspend, or discontinue any part of the service at any time. We will provide reasonable notice of material changes where possible.

You agree to:

• Provide accurate, complete, and up-to-date information when creating your account and entering programme data.
• Use the platform only for lawful purposes and in accordance with these Terms.
• Keep your login credentials confidential and notify us immediately if you suspect unauthorised access to your account.
• Ensure that all staff and portal users within your organisation also comply with these Terms.
• Not attempt to reverse-engineer, scrape, or interfere with the operation of the platform.

You are responsible for all activity that occurs under your organisation’s account, including actions taken by staff members and invited users.

You own your data. All cattle records, owner profiles, financial records, weight sessions, and other data you enter into AgriVest remain the property of your organisation.

We do not claim ownership of your data. We process it solely to provide and improve the service as described in our Privacy Policy.

You may export your data at any time using the built-in export tools. Upon account closure, you may request deletion of your data in accordance with our retention policy.

AgriVest is currently available on a free trial basis. Paid subscription plans will be introduced in a future release. When billing is activated:

• Payments will be processed via Paystack. By subscribing, you authorise us to charge your payment method on the agreed billing cycle.
• Subscription fees are charged in advance and are non-refundable unless required by applicable Kenyan law.
• If a payment fails, we will attempt to notify you and allow a grace period before suspending access.
• Pricing will be displayed clearly at the time of subscription and you will be given advance notice of any price changes.

The platform is provided “as is” and “as available”. To the fullest extent permitted by Kenyan law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

We will not be liable for any indirect, incidental, special, or consequential damages arising from your use of or inability to use the service, including but not limited to loss of profits, loss of data, or business interruption.

Our total liability to you for any claim arising from these Terms or your use of the service shall not exceed the total fees you paid to us in the three months preceding the claim.

By you: You may cancel your account at any time by contacting us at support@agrivest.co.ke. Upon cancellation, your access will remain active until the end of the current billing period (when billing is activated).

By us: We may suspend or terminate your account if you breach these Terms, if your subscription lapses and is not renewed within the grace period, or if required by law. We will provide notice where reasonably possible before taking such action.

Upon termination, your data will be retained for 90 days before being deleted, giving you time to request an export.

These Terms are governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from or relating to these Terms or your use of AgriVest shall be subject to the exclusive jurisdiction of the courts of Kenya.

We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the platform. Continued use of AgriVest after the effective date of any changes constitutes your acceptance of the revised Terms.
